Her attorney, Mark Rosen, characterized the legal pursuit as a “political vendetta,” arguing that her earlier missteps were merely technical errors that had already been rectified with a minimal fine from the Fair Political Practices Commission (FPPC).

Shaw has expressed a desire to implement changes to ensure that staff from the OC Department of Education meticulously review Form 700s for compliance, a practice he argues was lacking when Barke joined the board in 2018. “There was no malice there. She just was being sloppy and lazy, that’s not good,” he admitted, but he maintains that the penalties now being proposed are excessive for errors that may not have stemmed from ill intention.
